Terms & Conditions

This page tells you about the terms on which we sell the jewellery products (Products) listed on our website www.oritlondon.com (our site) to you.  Please read these terms and conditions carefully before ordering any Products from our site as, by ordering any of our Products, you agree to be bound by these terms.
1.1  www.oritlondon.com is operated by Orit London Limited (we).  We are registered in England and Wales our company number is 6954469 and our registered office at 98 Edith Grove, London SW10 0NH.  You can visit us in the real world at 95 Westbourne Park Villas, London W2 5ED.  Our VAT number is 891811602   


2.1  After placing an order, you will receive an e-mail from us acknowledging that we have received your order but this does not mean that your order has been accepted.  Your order is an offer to us to buy a Product which will only be accepted by us sending you an e-mail that confirms that the Product has been dispatched (the Dispatch Confirmation).  The contract between us (Contract) is formed when we send you the Dispatch Confirmation. 


3.1  You may cancel a Contract at any time within seven working days (Saturdays, Sundays and Bank Holidays don't count), beginning on the day after you received the Products.  If you do this you will get a full refund of the price paid for the Products in accordance with our refunds policy (see below). 
3.2  To cancel a Contract, you must inform us in writing or by email within the seven working day period outlined above and return the Product(s) to us as soon as you possibly can and in the same condition in which you received them.  You will have to pay the cost and take the risk of returning products so we recommend that you send them by Special Delivery.  You must take reasonable care of the Products while they are in your possession so please look after them as we may have a right of action against you for compensation if you don't.
3.3  Sorry, but you don't have any right to cancel a Contract for the supply of any of the following Products:
Bespoke Products made to your specification 
3.4   More details of this right, and an explanation of how to exercise it, are provided in the Dispatch Confirmation.  This provision does not affect your statutory rights.


Your Products will be sent by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within 30 days of the date of the Dispatch Confirmation, unless there are exceptional circumstances which prevent us from doing this in which case we will send them as soon as we can. 


5.1  It is your responsibility to look after the Products from the time of dispatch so please take care of them when received and ensure that you pay for insurance backed postage to ensure that you have protection whilst they are in the post.
5.2  When we receive full payment of all sums due in respect of the Products (including delivery charges) the Products will be yours.


6.1  The price of any Products will be as quoted on our site from time to time, except in cases of obvious error. 
6.2  These prices include VAT but exclude delivery costs, which will be added to the total amount due as set out in our Delivery Guide.
6.3  We may have to change our prices at any time, but any changes will not affect orders for which we have already sent you a Dispatch Confirmation.
6.4  Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced.  We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you.  If a Product's correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before sending the Product, or reject your order and notify you of such rejection. 
6.5  We are not obliged to provide any Product to you at the incorrect (lower) price (even after we have sent you a Dispatch Confirmation) if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.  If you think that an item is mis-priced please let us know. 
6.6   To pay us please use your debit or credit card.  We accept all major debit and credit cards.  We will not charge your card until we despatch your order.


7.1  When you return a Product to us:
(a)  because you have cancelled the Contract between us within the seven-day cooling-off period mentioned above, we will process your refund as soon as we can and certainly within 30 days of the day you have given notice of your cancellation. You will get back the price of the Product in full (including the cost of sending the item to you) but not the cost of returning the item to us.
(b)   for any other reason we will have a look at the returned Product and will let you know about any refund via e-mail within a reasonable period of time.  We will process the refund due to you as quickly as we can and, in any case, within 30 days of the day we emailed confirming that you were entitled to a refund. Products returned by you because of any defect will be refunded in full (including the delivery charges for sending the item to you and your cost in returning the item to us). 
7.2  We will usually refund any money received from you using the same method originally used by you to pay for your purchase.
7.3  Please note that we examine each Product individually before it is sent out and that we never send out an item that is damaged.


8.1 Any Product purchased from us is of satisfactory quality and reasonably fit for the purposes for which decorative jewellery of this kind may be used. 
8.2  All Products are sold as they appear on our site other than minor variations resulting from the fact that they are all individually handmade. 
8.3  Products which are plated will wear in a way which is unique to that particular Product and we are not liable for such wearing unless the Product can be shown to not be of satisfactory quality.
8.4  All Products are sold with care instructions (whether on the site or with the Product) and these instructions must be followed by you carefully.  We cannot accept returns of items where the care policy has not been followed.
8.5   If we break this agreement you can claim back the price of Products you have bought but no more.  
8.6   This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.


9.1 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination.  You will be responsible for payment of any such import duties and taxes.  Please note that we have no control over these charges and cannot predict their amount, so please check them before you place your order.


All notices given by you to us must be given to shop@oritlondon.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order.  Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.  In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.


11.1 As we are sure you appreciate we cannot be liable or responsible for any failure to perform, or delay in performance of, any of our obligations to you that is caused by events outside our reasonable control such as strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks or the acts, decrees, legislation, regulations or restrictions of any government (Unexpected Event). 
11.2 Our performance under any Contract is deemed to be suspended for the period that the Unexpected Event continues, and we will have an extension of time for performance for the duration of that period.  We will do our best to bring the Unexpected Event to a close or to find a solution so that we can complete the Contract.


12.1 These terms and the details in the Despatch Confirmation are the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
12.2  We each acknowledge that, in entering into a Contract, neither of us has relied on any representation or promise given by the other or be implied from anything said or written between us prior to such Contract except as expressly stated in these terms.


13.1  We may revise and amend these terms and conditions from time to time. 
13.2  You will be subject to the policies and terms in force at the time that you make your order, unless any change to those policies or these terms is required by law (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms before we send you the Dispatch Confirmation.


We are an English company and so contracts for the purchase of Products through our site and any dispute between us (including non-contractual disputes or claims) will be governed by English law and will only be dealt with by the English courts.
